Can a Hotel Stop You From Bringing Your Own Water?

The Answer
Hotels and restaurants are private commercial properties and legally reserve the right to restrict outside food or beverages, including your water bottle. However, they CANNOT force you to buy packaged mineral water and MUST provide free, clean, regular drinking water inside.
Article 19(1)(g) of the Constitution of India, 1950 (Protects a private establishment’s fundamental right to carry on any occupation, trade or business, including setting internal rules for their private property).

- Section 2(47) of the Consumer Protection Act, 2019 (Consumer courts classify forcing the purchase of bottled water by denying free regular water as an "Unfair Trade Practice").
- Schedule 4, Part V of the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011 (Mandates food and hospitality businesses to provide a safe, potable drinking water supply).

- K.C. Cinema v. State of Jammu and Kashmir (2023) — The Supreme Court ruled that cinema halls (and by legal extension, similar private commercial hospitality/entertainment establishments) are private properties. Management can legally prohibit outside water, provided they supply free, hygienic drinking water to patrons.
Myth vs Reality
Most people wrongly believe that because water is a basic human necessity, no private establishment or security guard can legally stop them from carrying their own bottle inside.
Private establishments can restrict outside beverages but must provide free, clean drinking water. Forcing purchase of bottled water is an unfair trade practice.
